The purpose of the SBMP is to record the types of soil binding products used and the methodologies proposed/used to ensure that there is no discharge to land in circumstances where the soil binding products enter water. [RM225019 (3)]
The SBMP must record: [RM225019 (3)]
the types of soil binding products used;
the mobility, hazard classification, toxicity, and effects of each of the products on water quality;
the methodologies used to ensure that there is no discharge to land which results in soil binding products entering water;
safety data sheets for the products used; and
the means of application.

Soil Binder Management Plan must be submitted to the Council’s Monitoring Officer for certification at least 5 working days prior to the first application of soil binders. [RM225019 (3)]

Use of soil binding products must follow the manufacturers Safety Data Sheet provided with the product. [RM225019 (5)]
No soil binding products shall be discharged:
within 25 metres of York Stream or its tributaries [RM225019 (6)]; or
located within any overland flow path nor any location where they may be intercepted and temporarily diverted around such areas until such times as the binder has dried and set. [RM225019 (7)]

The NTRLBU must keep a record of the application of soil binding products. [RM225019 (4)]
As a minimum, it must record: [RM225019 (4)]
The product used for soil binding/stabilisation purposes;
The areas and locations treated with soil binding products (including in relation to watercourses and clean/dirty water diversions; and
The volumes of product used.
The record must be made available on request by the Council’s Monitoring Officer. [RM225019 (4)]

At least 5 working days prior to the first discharge of contaminants authorised by this consent, the Consent Holder shall submit a Soil Binder Management Plan (SBMP) to Council’s Monitoring Officer for certification. The purpose of the SBMP is to record the types of soil binding products used and the methodologies proposed/used to ensure that there is no discharge to land in circumstances where the soil binding products enter water. As a minimum, the SBMP shall include the following:
(a) the type of soil binding products used (this can be updated, and recertified, if alternative soil binding polymers are proposed to be used at any time);
(b) the mobility, hazard classification, toxicity, and effects of each of the products on water quality;
(c) the methodologies proposed to ensure that there is no discharge to land in circumstances where soil binding products enter water;
(d) safety data sheets for the products used; and
(e) the means of application.
Note: The Certification of the SBMP by the council relates only to those aspects of SBMP that are relevant under the Resource Management Act 1991. The certification does not amount to an approval or acceptance of suitability by the council of any elements of the management plan that relate to other legislation, for example, but not limited to, the Building Act 2004, the Heritage New Zealand Pouhere Taonga Act 2014, or the Health and Safety in Employment Act 1992.
